These Terms and Conditions govern entry into the Why Not? Pre-Sale Competition (the "Competition"). By entering the Competition, each entrant accepts and agrees to be bound by these Terms and Conditions and by the decisions of the Promoter, which are final.
The Promoter is Formston Consulting Pty Ltd (ABN 11 616 178 619) of Wamberal, NSW, Australia (the "Promoter").
The Competition commences on 18 June 2026 and closes at 10:00pm AEST on 31 July 2026 (the "Promotion Period"). Entries received outside the Promotion Period will not be accepted.
Entry is open to permanent residents of Australia aged 18 years and over at the time of entry. Employees and contractors, and their immediate family members, of the Promoter and of the participating partners (Optus, JS Industries, and Billabong) are ineligible to enter.
To enter, an entrant must, during the Promotion Period:
One (1) entry is permitted per purchase of Why Not? Each entry must be the entrant's own original work. Incomplete, illegible, or otherwise ineligible entries may be disqualified at the Promoter's discretion.
Each entrant must retain valid proof of purchase of Why Not? and provide it upon request. The Promoter may require proof of purchase in order to validate an entry or a prize claim. Entries that cannot be validated may be disqualified.
The Competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged by Matt Formston, together with his team of representatives, who will select the entries considered to demonstrate the most compelling and original "Why Not" story. The judges' decision is final and binding, and no correspondence will be entered into. In the event of a tie, an additional representative will be appointed to cast the deciding vote.
There are three (3) prizes and three (3) separate winners. Each winner will receive one (1) prize only. The prizes are:
The total prize pool is valued at over AUD $3,500. All prize values are recommended retail prices, are correct as at 12 June 2026, and are subject to change.
Prizes are not transferable or exchangeable and cannot be redeemed for cash. Each prize is supplied by the relevant partner. It is the responsibility of each winner to contact the supplier of their prize to arrange delivery or collection. Any costs associated with claiming or using a prize that are not expressly stated as included are the responsibility of the winner. Should a prize become unavailable for any reason, the Promoter may substitute a prize of equal or greater value, subject to applicable law. Nothing in these Terms and Conditions limits any rights an entrant may have under the Australian Consumer Law.
Entries close 31 July 2026, 10pm AEST and announced on 4 August 2026. The Promoter will attempt to contact each winner up to three (3) times using the contact details provided at entry. Winners may also be announced on the Site and the Promoter's channels. By entering, each entrant consents to the publication of their first name and entry in the event they are selected as a winner.
In order to claim a prize, a winner may be required to verify their identity, age, residency, and proof of purchase. Prizes must be claimed by 27 August 2026. If a winner cannot be contacted, fails to respond, fails to claim their prize by this date, or is found to be ineligible, the Promoter will conduct a re-draw and select a replacement winner from the remaining valid entries, judged on the same basis, subject to any direction from the relevant regulatory authority.
By entering, each entrant grants the Promoter and the participating partners a non-exclusive, royalty-free, perpetual, and irrevocable licence to use, reproduce, publish, and communicate their entry, including the "Why Not moment", for promotional and marketing purposes in any media, without further notice, payment, or compensation. Each entrant warrants that their entry is their own original work and does not infringe the rights of any third party.
The Promoter collects each entrant's personal information for the purpose of conducting the Competition. By entering, each entrant acknowledges and agrees that their entry details will be shared with the Promoter's partners, Optus, JS Industries, and Billabong, and that they will receive marketing communications from those partners and the Promoter. Entrants may opt out of marketing from each partner via the unsubscribe facility in those communications. All personal information is collected, used, and disclosed in accordance with the Promoter's Privacy Policy, available at mattformston.com/privacy-policy.
To the maximum extent permitted by law, the Promoter and the participating partners accept no liability for any loss, damage, or injury arising from participation in the Competition or the use of any prize. The Promoter accepts no responsibility for entries that are lost, delayed, corrupted, or not received for technical or other reasons beyond its reasonable control. Nothing in these Terms and Conditions excludes, restricts, or modifies any right under the Australian Consumer Law that cannot lawfully be excluded.
The Promoter may, subject to applicable law and any regulatory direction, vary these Terms and Conditions or cancel, suspend, or amend the Competition where it considers it necessary to do so. The Promoter may disqualify any entrant who tampers with the entry process, submits an entry that is not their own, or otherwise breaches these Terms and Conditions. Each winner is responsible for any taxation implications arising from receipt of a prize and should obtain independent advice.
Where the Competition is promoted on social media platforms, it is in no way sponsored, endorsed, administered by, or associated with those platforms.
These Terms and Conditions are governed by the laws of New South Wales, Australia, and each entrant submits to the non-exclusive jurisdiction of the courts of that State.
